These terms govern your use of the Baby Base website and services (the “Platform”). By creating an account or using the Platform you agree to them. If you don’t agree, please don’t use Baby Base.
Baby Base is an online venue where people in South Africa list, find and arrange to buy pre-loved baby and kids’ items from each other.
Baby Base is not a party to any sale. We don’t own, hold, inspect, deliver or guarantee any item, and we don’t process or hold payments. Every sale is a private agreement between the buyer and the seller, who arrange payment and handover themselves.
Using Baby Base is free. There are no listing fees and no commission. We may introduce optional paid features in future; if we do, they will be clearly marked and never charged without your agreement.
You must be 18 or older to create an account. Keep your login details private and tell us immediately if you think your account has been used without permission. You are responsible for everything done through your account. One person, one account.
When you list an item you confirm that you own it and have the right to sell it, that your description, photos and condition grade are accurate and honest, and that the price is the full price you expect to receive.
You may not list: items subject to a manufacturer or regulator recall; car seats or boosters that have been in a collision, are damaged, or are past the manufacturer’s expiry; cots that don’t meet safety standards (including drop-side cots); counterfeit goods; medicines, supplements or infant formula; anything illegal or that you are not entitled to sell.
Do not include photos of children in listings. Photograph the item, not the child.
Buyers and sellers agree the price, meeting place and payment method between themselves. We strongly recommend meeting in a public place, checking the item together, and paying only in person once you are satisfied. Read our safety guide.
Sales between private individuals are private sales. If you sell on Baby Base in the ordinary course of a business, you are responsible for complying with the Consumer Protection Act and all other laws that apply to you.
You agree not to: harass, threaten or deceive other users; post content that is unlawful, misleading, defamatory or infringes someone else’s rights; use Baby Base to advertise other services or send spam; scrape or copy the Platform or its content; or attempt to interfere with the Platform’s operation or security.
You keep ownership of the photos and text you post. You give us a non-exclusive, royalty-free licence to display and share them on and for the Platform (for example, on the listing page and in social previews) for as long as they are on Baby Base.
We may remove any listing or content, and suspend or close any account, if we reasonably believe these terms have been broken, the law requires it, or it is necessary to protect users or the Platform. Where we can, we will tell you why.
If a listing or user concerns you, email hello@babybase.co.za with the listing link and what happened. A real person reviews every report. Baby Base will never contact you asking for a payment or your card details.
The Platform is provided “as is”. We don’t promise it will always be available or error-free, and we don’t verify the identity of users or the condition, safety or legality of items. To the fullest extent permitted by South African law, Baby Base is not liable for any loss or damage arising from a sale between users, from an item bought or sold on the Platform, or from your use of the Platform. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that cannot be excluded.
You agree to cover any loss, claim or cost we reasonably incur because of your breach of these terms or your use of the Platform in a way that is unlawful or harms others.
How we collect and use personal information is explained in our Privacy Policy, which forms part of these terms.
We may update these terms from time to time. We will post the new version here with an updated date and, for material changes, notify registered users by email. Continuing to use Baby Base after a change means you accept it.
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
